This legal notice sets out the general conditions governing access to and use of this website, which is owned by the General Secretariat for Innovation and Quality of the Public Justice Service.
Use of the website implies express and full acceptance of these
general conditions in the version published at the time the user
accesses it, without prejudice to any special conditions that may
apply to some of the specific contents or services of the
website.
For the purposes of this document, "reusing
agent" is understood to be any individual or legal entity that
reuses public sector information, whether for commercial or
non-commercial purposes.
Obligatory nature of the general terms and conditions.
These general conditions, permanently available at datos.gob.es/aviso-legal, shall bind any reusing agent by the mere fact of making use of the documents subject to them.
Authorisation for re-use and non-exclusive transfer of intellectual property rights.
These general terms and conditions permit the re-use of the documents subject to them for commercial and non-commercial purposes. Re-use is understood to be the use of documents held by the bodies of the General State Administration and the other bodies and entities of the state public sector referred to in article 1.2 of Royal Decree 1495/2011, of 24 October, which implements Law 37/2007, of 16 November, on the re-use of state public sector information, by individuals or legal entities, for commercial or non-commercial purposes, provided that such use does not constitute a public administrative activity. Authorised re-use includes, by way of illustration, activities such as copying, disseminating, modifying, adapting, extracting, rearranging and combining information.
The concept of document is that established in section 2 of article
3 of Law 37/2007, of 16 November, on the re-use of public sector
information, and therefore includes all information, whatever its
material or electronic medium, as well as the form of graphic, sound
or image expression used, including, consequently, also data at the
most disaggregated or "raw" levels.
This authorisation
also entails the free and non-exclusive transfer of the intellectual
property rights, where applicable, corresponding to such documents,
authorising the carrying out of reproduction, distribution, public
communication or transformation activities, necessary to develop the
authorised reuse activity, in any modality and under any format, for
the whole world and for the maximum period permitted by Law.
General conditions for re-use.
The following general conditions apply to the re-use of the documents
subject to them:
1. It is forbidden to distort the meaning of
the information.
2. The source of the documents subject to
re-use must be cited. This citation may be made in the following way:
"Origin of the data: the General Secretariat for Innovation and
Quality of the Public Justice Service".
3. The date of the last update of the documents subject to re-use
shall be mentioned, provided that it was included in the original
document.
4. It shall not be stated, implied or suggested
that the General Secretariat for Innovation and Quality of the Public
Justice Service, the owner of the re-used information, participates
in, sponsors or supports the re-use carried out with it.
5.
Metadata on the date of update and applicable conditions for re-use
included, where applicable, in the document made available for re-use
must be retained, not altered or deleted.
Exclusion of liability.
The use of the datasets shall be made by the users or agents of the re-use at their own risk, and they shall be exclusively liable to third parties for any damage that may arise from it.
The General Secretariat for Innovation and Quality of the Public Justice Service shall not be liable for the use made of its information by the reusing agents, nor for any damage suffered or economic loss which, directly or indirectly, produces or may produce economic, material or data damage caused by the use of the reused information.
The General Secretariat for Innovation and Quality of the Public
Justice Service does not guarantee the continuity in the provision of
reusable documents, neither in content nor in form, nor does it assume
responsibility for any error or omission contained therein.
Responsibility of the reusing agent.
The reusing agent is subject to the regulations applicable to the reuse of public sector information, including the penalties set out in article 11 of Law 37/2007, of 16 November, on the reuse of public sector information.
Protection of personal data.
The Public Business Entity Red.es is committed to complying with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), as set out in the following link: Protection of Personal Data.
Modifications.
In order to improve the performance of the website, The General Secretariat for Innovation and Quality of the Public Justice Service reserves the right, at any time and without prior notification to the user, to unilaterally modify, extend or temporarily suspend the presentation, configuration, technical specifications and services of the website.
Hyperlinks.
The hyperlinks contained on the website may lead to the websites of third parties. The General Secretariat for Innovation and Quality of the Public Justice Service assumes no responsibility for the content, information or services that may appear on these sites, which are for information purposes only and in no case imply any relationship between the State Secretariats for Public Administrations and Telecommunications and for the Information Society and the persons or entities that own such content or the owners of the sites where they are located.
Multilingual version.
This website is translated into several official Spanish languages in
their respective territories, in accordance with the provisions of
Article 3 of the Spanish Constitution of 1978 and its Statutes of
Autonomy. The languages are Catalan, Basque and Galician. It is also
translated into one foreign language, English.
The content of
the portal is translated at different levels of depth. It includes
translations of the navigation menus, static texts and those contents
whose origin and frequency of updating makes translation
possible.
It should be noted that, in general, there may be a
time lag between the Spanish version and the other languages, as a
result of the translation process.
PRIVACY
In accordance with the General Data Protection Regulation, RGPD Organic Law 3/2018, the Ministry of Justice undertakes to comply with its obligation of secrecy with regard to personal data and the duty to treat them confidentially. To this end, it will adopt the necessary measures to prevent their alteration, loss, processing or unauthorised access.
The purpose of the collection and automated processing of personal data is the management, provision, extension and improvement of the services requested at any given time by the user and the follow-up of queries raised by users.
You may exercise your rights of access, rectification, cancellation and opposition of your personal data held in the files of the MINISTRY OF JUSTICE, by requesting this by any means that provides proof of sending and receipt. To exercise your rights, you may write to the Ministry's Central Office for Citizen Services and Registry.
THE MINISTRY OF JUSTICE maintains the levels of protection of your
personal data in accordance with RGPD Organic Law 3/2018, on the
protection of personal data, and has established all the technical
means at its disposal to prevent the loss, misuse, alteration,
unauthorised access and theft of the data you provide to the MINISTRY
OF JUSTICE, without prejudice to the fact that security measures on
the Internet are not impregnable.
